Mary Alexander Wins $45 Million Dollar Car Accident Verdict

A recent multi-million dollar award for a quadriplegic car accident victim has been called a victory for the rights of accident victims whose lives have been altered as a result of the negligent actions of others.

April 18, 2009 - A California court has awarded a quadriplegic car accident victim the sum of $45 million for injuries sustained from an accident that occurred in 2006. San Francisco attorney, Mary Alexander, who represented the victim, Tricia Roth, regards the case outcome as "a proper victory for victim's rights."

As outlined in documents filed in the case of Tricia Roth vs. Division 1 All Service, Inc., Roth was struck by Roman Pantoja in her vehicle, after Pantoja ran a red light at an intersection. Roth became paralyzed after breaking her neck in the impact. As stated in court documents, "when the cars came to rest, Tricia Roth could not move her legs... could not move her arms, she was rendered a quadriplegic.  Her neck was broken." Alexander stated in court of her client, "She will never be able to return to work... her life expectancy is reduced." She further noted that Roth "had been very active, swimming, horseback riding.  A particular interest that she and her husband, Kay Huh, had was ballroom dancing.  They were very good at it...it was very important to them, one of their activities that they enjoyed together."

The San Mateo County Court found Pantoja to have been in the course of carrying out work related duties for his employer Division I, at the time of the accident, making the company liable in terms of damages incurred as a result.  The court awarded Roth damages for medical expenses, lost income, and pain and suffering and also allocated sums for her husband of six years for loss of consortium and lost earnings after becoming almost a fulltime caregiver to his wife.
