Mary Alexander & Associates Files Lawsuit Against Elements Massage for Alleged Sexual Assault by Massage Therapist
SAN FRANCISCO, March 18, 2025 – Mary Alexander & Associates, P.C. filed a lawsuit against Elements Massage, alleging sexual assault, negligence and failure to protect clients from harm. A massage therapist at Elements Massage’s Walnut Creek location sexually assaulted the plaintiff (who is referred to by the pseudonym ‘Jane Doe’ to protect her identity).
According to the complaint, Jane Doe visited Elements Massage on March 11, 2024, for a massage appointment. During the session, she was sexually assaulted by a male massage therapist, identified as Johnathan Levy. Levy touched and groped Jane Doe’s vagina while she was in a vulnerable position, undressed, and under the care of Elements Massage, who allowed Levy to have skin-to-skin contact with her.
The complaint includes multiple causes of action, including:
- Negligence
- Negligent Hiring, Retention, and Supervision
- Premises Liability
- Sexual Battery (Civ. Code § 1708.5)
- Violation of the Ralph Act (Civ. Code § 51.7)
- Intentional Infliction of Emotional Distress

The lawsuit seeks damages for the physical, emotional and psychological harm that Jane Doe suffered as a result of what she went through, as well as punitive damages to hold the defendants accountable for their gross negligence.
